2015 in Review: Seven Tips for Hospitals As They Enter the Next Evolution of Post-Affordable Care Act, Value-Based Payment

This session will review some of the major legal, regulatory and legislative developments of 2015, focusing on how they may affect hospital transactions going forward, particularly when fair market value and commercial reasonableness are legal imperatives for those transactions.

Topics will include:

  • The ongoing shift to value-based reimbursement following the Affordable Care Act, including how hospitals might need to alter relationships with physicians and other providers in the next phase of implementation;
  • 2015 legislative and regulatory developments affecting hospitals and their relationships with other providers, including MACRA, certain changes to the Stark regulations, proposed interpretive changes to 340B, developments in the bundled care payment initiative, changes to the ACO regulations, and new legislation that may result in changes to billing and payment rules for certain hospital services;
  • New and surprising enforcement activity related to the Stark Law, Anti-kickback Statute and other laws governing hospital transactions; and
  • Transactional trends and hot topics of 2015, including those related to incorporating incentives into arrangements for employment, professional services, clinical integration, gainsharing, management/co-management, research services and accountable care.

Together with a panel of hospital counsel and business leaders, we will provide and discuss examples of trouble spots and hot button issues, and provide tips for best practices to address them based on the developments of 2015 and the look ahead.
